4. Payment terms

Payment is processed directly by Stripe Inc. via Stripe Checkout. Credit card data never transits through BVY servers.

For one-time services (VALD Assessment, In-person session), full payment is required at the time of booking. The order is confirmed as soon as Stripe confirms successful payment.

For the BVY app subscription (monthly), the first payment occurs at subscription, then each month on the subscription anniversary date, until cancellation by the client (see section 6).

Accepted payment methods: Visa, Mastercard and American Express via Stripe.

5. Service delivery terms

VALD Assessment: the date and time of the appointment are chosen by the client among the slots opened by BVY at the time of booking. The appointment takes place in person at the location indicated on the booking page (until June 26, 2026: CEGEP de Sainte-Foy, Quebec). The PDF report is delivered to the client by email within 7 calendar days following the session.

In-person session: the date and time of the appointment are chosen by the client among the slots opened by BVY. The location is specified upon confirmation.

BVY app subscription: app access is activated within a maximum of 48 hours after payment. Monthly follow-up includes an updated personalized training plan, in-month adjustments on request, and asynchronous exchanges with Corentin Hery.

6. Cancellation, rescheduling and refund

One-time services (VALD Assessment, In-person session):

  • Cancellation by the client more than 3 hours before the session: full automatic refund via Stripe, no fee or justification required. The refund is initiated within a maximum of 15 calendar days following the request, in accordance with Quebec's Consumer Protection Act (LPC art. 54.10).
  • Cancellation by the client less than 3 hours before the session, or no-show: no refund, the session is forfeited. Exception: documented force majeure (medical certificate, death in immediate family, serious family emergency): upon submission of supporting documents by email, rescheduling without fee is granted.
  • Rescheduling possible up to 3 hours before the session, no fee, to another available slot.
  • Cancellation by BVY (force majeure, instructor unavailability, etc.): full refund AND offer of a priority new slot.

Cancellations and rescheduling are handled by email to contact@corentinherybvy.com. The reference time is the time the email is received on BVY's side (Eastern Time).

BVY app subscription (monthly):

  • Cancellation possible at any time by the client, by simple email to contact@corentinherybvy.com, no fee or penalty, no minimum commitment period.
  • Cancellation takes effect at the end of the current monthly period (the started month remains due and fully usable).
  • Written confirmation of cancellation sent by BVY within 10 calendar days.
  • No prorated refund for the started month.

7. Right to rescind a distance contract

Quebec's Consumer Protection Act (LPC, art. 54.8) and Ontario's Consumer Protection Act, 2002 (CPA, art. 40) provide a right to rescind a distance contract only in case of breach by the merchant of its pre-contractual disclosure obligations.

Applicable rescission period:

  • 7 calendar days from the conclusion of the contract if the merchant has breached its pre-contractual disclosure obligations (LPC art. 54.4 / Ontario CPA art. 38).
  • 30 calendar days from the conclusion of the contract if a written copy of the contract has not been delivered to you.
  • The right to rescission no longer applies to a service already delivered (VALD Assessment or In-person session already held).
  • For the BVY app subscription: the right applies as long as app access has not been activated.

BVY commitment: to satisfy its pre-contractual disclosure obligations, BVY transmits to each client, immediately after Stripe payment: (a) a copy of these Terms via email link, (b) a written confirmation of the booked service and its price, (c) the cancellation and refund policy. This automatic delivery constitutes the remittance of the contract copy under the LPC.

When the right to rescission applies, requests are sent by email to contact@corentinherybvy.com. Refund is issued within 15 calendar days following receipt of an admissible request.

Outside the above cases (merchant compliant with disclosure obligations), cancellation remains possible under section 6 (3-hour notice before session, documented force majeure).

8. Liability and health warning

BVY services include high-intensity physical training. These services carry inherent risks (muscle soreness, injury, cardiac overload).

By booking an in-person service or subscribing to the BVY app, you declare yourself to be in a state of health compatible with intense sports practice. In case of a pre-existing medical condition (cardiac, joint, metabolic, etc.) or doubt, you agree to consult a physician before subscribing and to disclose to BVY any relevant information before the first session.

BVY cannot be held liable for injury or damage occurring outside sessions directly supervised by Corentin Hery, or resulting from non-compliance with given instructions. This limitation applies subject to article 1474 of the Civil Code of Quebec, which prohibits any exclusion or limitation of liability for bodily or moral harm caused to others: such harm caused by gross or intentional fault of BVY remains compensable in accordance with the law.

VALD reports and training plans delivered as part of the services do not constitute medical prescriptions and do not replace professional health advice.

9. Minor client (athletes under 18)

BVY services target a sports population that frequently includes minor athletes (under 18).

For any minor client:

  • Booking and payment must be made by a parent or legal guardian of legal age, acting on behalf of the minor.
  • The parent or guardian acknowledges having read and accepted these Terms on behalf of the minor, including the fitness declaration (section 8) and the collection of VALD performance data during the VALD Assessment (see Privacy Policy).
  • BVY may ask the parent or guardian to confirm this authorization in writing (email is sufficient) before the first session.
  • Any contract entered into directly by a minor without this parental authorization may be voided at the request of the parent or guardian, with full refund of amounts paid if the service has not started.

10. Intellectual property of deliverables

VALD PDF reports, personalized training plans, exercise videos and all content delivered to the client as part of the services are for personal and exclusive use of the client.

Any reproduction, distribution, resale or commercial exploitation of this content, without prior written authorization from Corentin Hery, is strictly prohibited and engages the civil and criminal liability of the violator.

11. Applicable law and dispute resolution

These Terms are governed by Canadian federal law and by the laws in force in the province of BVY's residence at the time of the dispute (Quebec until June 26, 2026, then Ontario as of June 27, 2026).

In case of dispute, the parties favor amicable resolution. In case of failure, the competent courts are those of the province of BVY's residence.

For consumers residing in Quebec, the mandatory provisions of Quebec's Consumer Protection Act remain applicable notwithstanding this clause.

12. Modifications to the Terms

BVY reserves the right to modify these Terms at any time to reflect changes in offerings, legislation or technical tools.

The Terms applicable to an order are those in force at the time the order is placed. The "last updated" date at the top of this page is kept current with each modification.

For subscriptions (BVY app), any substantial modification to the Terms affecting your rights will be notified by email at least 30 days before entry into force. You may then cancel freely if the new terms do not suit you.

If a provision of these Terms is found to be void or unenforceable by a competent court, the other provisions remain in full effect. The French version of the Terms shall prevail in case of discrepancy with the English version.
